Pav Sina urges stakeholders to review employers who close factories and fail to pay legal compensation to workers

Phnom Penh: President of the Collective Union of Movement of Workers (CUMW), Pav Sina, urged all stakeholders to review the employers who used the excuse of loss of order and the Covid-19 epidemic and closed the factory by not paying compensation is a legitimate benefit to workers that has caused economic hardship and workers' costs.

It has been observed that in Cambodia, most factory owners, when closed, never consider paying legal compensation to their employees, always avoiding legal liability and we have never seen Cambodian stakeholders present reports or solutions to this problem.

"It is not uncommon for employers to shut down and not pay their legal benefits, it has been a long time coming," Sina said. in Cambodia, there is no law to punish any investor who is not responsible for the loss of benefits of workers, especially non-payment of compensation to workers. He Said.

"However, if we refer to the labor law, the employer who terminates the employment contract unilaterally is to provide the various compensation stipulated in the law to the workers whose employers close the factory without notice and any no compensation is against the law."

He added that the use of the word bankruptcy is a popular word and an excuse for employers to evade payment because the use of the word bankruptcy can help employers out of the obligation to pay compensation. Other to workers.

Pav Sina stated that, "On the contrary, we rarely see that the factory closed or the boss ran away, there is no local institution, we show a report to the factory closed. "We have never seen the cause of the closure or whether there was a court ruling that found the factory bankrupt."

"I think the parties concerned should reconsider this issue because from year to year, the workers lose a lot of benefits due to the irresponsible actions of the employers who have closed or fired the workers," he said. Non-payment of construction and the pretext of the Covid-19 pandemic to avoid liability is unreasonable, as covid is endemic in every country in the world, even in the absence of a Covid crisis the Problem has been happend through this in the past."
