Phnom Penh: Workers terminated without notice may be entitled to compensation including unpaid wages, payment for unused annual leave, notice pay (in lieu of notice), seniority pay (where applicable), and severance pay, depending on the type of employment contract (fixed-term or indefinite) and the specific terms and conditions of employment.
For a fixed-term employment contract, the employer is required to provide prior notice—typically 10 or 15 days, depending on the contract duration—before termination. If no notice is given, the employer must pay compensation in lieu of notice.
For an indefinite-term employment contract, the employer must provide written notice ranging from 7 days to 3 months, depending on the length of service. If no notice is given, the employer must pay compensation in lieu of notice as well as severance pay.
However, workers dismissed for serious misconduct may not be entitled to full benefits, with the exception of unpaid wages and payment for any remaining annual leave.
