Workers Have the Right to Join the Union Movement

Phnom Penh:  workers in Cambodia who work in all fields have the right to form a union and be a member of a union as defined by the Cambodian Constitution and labor law.

However, this right is below certain limits. The Union Law in Cambodia sets specific eligibility criteria for union leaders, activists, and members who can exercise their right to participate in the formation of unions at the grassroots level, or in the factories of which they are working.

Although the legal framework supports unity, workers often face significant challenges on the part of employers.  Anti-union discrimination is still occurre, with employers often opposing union formation efforts in their factories, enabling union leaders to engage in collective bargaining to protect the rights and interests of all workers.

The Cambodian government provides full rights for workers to join the union movement, but practices seem to be inconsistent as many workers continue to face harassment and intimidation when they exercise their right to form unions, especially independent unions are often interfered with by employers.

In fact, the Collective Union of Movement of Workers (CUMW) still faces discrimination against its members when they form a union and are threatened by their employers not to participate in the formation of the union and to be fired, and using short-term employment contract, which remains an obstacle for workers to join the union movement.

Unions are independent professional organizations that uphold the rights, freedoms and interests of all workers.  Unions play a key role in collective bargaining for better working conditions and the legitimate interests of workers.  Employers and unions should work together to achieve the Cambodian government's policy under the motto "One enterprise one peaceful community."
